1. TERMS OF SERVICE

Welcome to SpaghettiMiniatures.com (the "Site"). Please read these Terms of Service ("Terms") carefully. By accessing or using the Site, or by placing an order through it, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1.1 Who We Are — Two Companies, Two Roles

The Site is operated through a partnership between two independent companies. Understanding their separate roles will help you know who is responsible for what:

Spaghetti Miniatures LLC ("Spaghetti Miniatures," "Content Publisher") owns the SpaghettiMiniatures.com domain and is responsible for all editorial content on the Site, including blog posts, articles, product reviews, ratings (including "The Spaghetti Score"), tutorials, and embedded videos from the Spaghetti Miniatures YouTube channel.

TIUS Corp, 221 Douglas Rd E, Oldsmar, FL 34677, USA ("TIUS," "Seller," "we," "us" for all commerce purposes) is the merchant of record for every product sold on the Site. TIUS operates the online store, processes payments, fulfills and ships orders, handles returns and refunds, and provides all customer service related to purchases.

When you buy a product on this Site, your purchase contract is with TIUS Corp, not with Spaghetti Miniatures LLC. When you read a review, article, or watch a video on this Site, that content is published by Spaghetti Miniatures LLC, not by TIUS Corp.

1.2 Eligibility

You must be at least 18 years old, or the age of majority in your state, to make a purchase on the Site. By placing an order, you represent that you meet this requirement.

1.3 Products, Pricing, and Orders

  • All products are sold by TIUS Corp. Product listings, prices, and availability may change at any time without notice.
  • Prices are in U.S. dollars. Applicable sales tax is calculated at checkout.
  • We ship within the United States only. Orders with delivery addresses outside the U.S. cannot be accepted.
  • An order is accepted when TIUS Corp confirms shipment. TIUS may refuse or cancel any order (for example, due to pricing errors, suspected fraud, or stock issues); if payment was taken, it will be refunded in full.
  • Occasional errors in product descriptions or pricing may occur; TIUS reserves the right to correct them and to cancel affected orders with a full refund.

1.4 Payments

Payments are processed through the Site’s e-commerce platform (Shopify) and its supported payment providers. TIUS Corp does not see or store your full card number. By submitting payment, you represent that you are authorized to use the payment method provided.

1.5 Shipping, Returns, and Warranty

Shipping and delivery are governed by our Shipping Policy, and returns by our Returns & Refunds Policy, both of which are part of these Terms. Manufacturer warranty claims for products purchased on the Site are handled by TIUS Corp — contact spaghetti.miniatures@gmail.com with your order number.

1.6 Editorial Content — No Professional Advice

Reviews, scores, tutorials, and other editorial content on the Site reflect the independent opinions and testing of Spaghetti Miniatures LLC. Content is provided for general information only and is not a guarantee of any product’s performance for your specific use. Product specifications should be confirmed with the manufacturer. See our Editorial Independence & Commercial Disclosure statement for how content and commerce are kept separate on this Site.

1.7 Intellectual Property

  • Editorial content (articles, reviews, photographs, videos, "The Spaghetti Score" name and methodology) is owned by Spaghetti Miniatures LLC or its licensors.
  • Product names, logos, and images (including RichPen® marks) are the property of their respective owners and are used with authorization.
  • You may not copy, republish, or commercially exploit any Site content without prior written permission from its owner.

1.8 User Conduct

You agree not to misuse the Site: no unlawful activity, no attempts to interfere with the Site’s operation or security, no scraping or bulk data collection, and no posting of unlawful, infringing, or abusive material in any comment or review feature the Site may offer. Either company may remove content or restrict access at its discretion.

1.9 Third-Party Links and Embedded Media

The Site contains links to and embedded media from third-party platforms, including YouTube. Those platforms have their own terms and privacy policies, which govern your use of them. Neither Spaghetti Miniatures LLC nor TIUS Corp is responsible for third-party platforms.

1.10 Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, BOTH SPAGHETTI MINIATURES LLC AND TIUS CORP DISCLAIM ALL WARRANTIES REGARDING THE SITE AND ITS CONTENT, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PRODUCTS SOLD BY TIUS CORP ARE COVERED BY THE WARRANTY TERMS STATED IN THEIR DOCUMENTATION AND BY ANY RIGHTS PROVIDED BY APPLICABLE LAW; NOTHING IN THESE TERMS LIMITS RIGHTS THAT CANNOT BE LIMITED BY LAW.

1.11 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) NEITHER COMPANY IS LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE; (b) TIUS CORP’S TOTAL LIABILITY ARISING FROM ANY PRODUCT PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PURCHASE; (c) SPAGHETTI MINIATURES LLC HAS NO LIABILITY ARISING FROM ANY PRODUCT SALE, AND TIUS CORP HAS NO LIABILITY ARISING FROM ANY EDITORIAL CONTENT. Some states do not allow certain limitations, so parts of this section may not apply to you.

1.12 Indemnification

You agree to indemnify and hold harmless Spaghetti Miniatures LLC and TIUS Corp from claims arising out of your violation of these Terms or misuse of the Site.

1.13 Governing Law and Disputes

These Terms, and any purchase made on the Site, are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute shall be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to their jurisdiction. 1.14 Changes to These Terms

We may update these Terms from time to time. The "Effective date" above shows the current version. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

2. PRIVACY POLICY

This Privacy Policy explains how information is collected and used on SpaghettiMiniatures.com. Two companies are involved in operating this Site, and each is responsible for the data connected to its role:

  • TIUS Corp (merchant of record) is responsible for data related to shopping and orders: your name, shipping and billing address, email, phone number, order history, and payment confirmation data processed through Shopify.
  • Spaghetti Miniatures LLC (content publisher) is responsible for data related to content features it operates, such as comments or content-related email communications, if offered.

2.1 Information We Collect

  • Order information: name, shipping address, email address, phone number, and items purchased — collected by TIUS Corp when you place an order.
  • Payment information: processed by Shopify Payments or the payment provider you choose at checkout. Neither company sees or stores your full card number.
  • Device and usage information: IP address, browser type, pages viewed, and referral source — collected automatically through cookies and similar technologies via Shopify and analytics tools.
  • Communications: any information you send us by email or through Site contact forms.

2.2 How Information Is Used

  • To process, fulfill, and ship your orders, and to provide customer service (TIUS Corp).
  • To send transactional emails such as order confirmations and shipping notifications (TIUS Corp).
  • To send marketing emails if you opt in — you can unsubscribe at any time using the link in any marketing email.
  • To operate, secure, and improve the Site, and to understand how visitors use it.
  • To comply with legal obligations, including tax and accounting requirements.

2.3 Sharing of Information

We do not sell your personal information. Information is shared only with service providers who help operate the Site and fulfill orders: Shopify (e-commerce platform and hosting), payment processors, shipping carriers, email service providers, and analytics providers — each only to the extent needed to perform its function. Information may also be disclosed if required by law or to protect our legal rights. Because the store and content sides of the Site are run by two companies, order data controlled by TIUS Corp is not used by Spaghetti Miniatures LLC for editorial purposes, and vice versa.

2.4 Cookies

The Site uses cookies that are necessary for the store to function (such as keeping items in your cart) and optional cookies for analytics. Embedded third-party media, such as YouTube videos, may set their own cookies subject to those platforms’ policies. You can control cookies through your browser settings; disabling necessary cookies may prevent checkout from working.

3. SHIPPING POLICY

Effective date: August 11, 2026

All orders on SpaghettiMiniatures.com are sold, fulfilled, and shipped by TIUS Corp from our facility in Oldsmar, Florida.

3.1 Shipping Area

We currently ship within the United States only. We are unable to accept orders with delivery addresses outside the U.S., including U.S. territories where carrier service is unavailable. If international shipping becomes available in the future, this policy will be updated.

3.2 Processing and Delivery Times

  • Orders are typically processed and shipped within 1–3 business days after payment confirmation.
  • Domestic delivery typically takes 2–5 business days after shipment, depending on destination and carrier.
  • Estimated delivery dates shown at checkout are estimates, not guarantees. Carrier delays can occur, especially during holidays.

3.3 Tracking

Every shipment includes a tracking number, emailed to you when your order ships. Please allow up to 24 hours for tracking to activate.

3.4 Address Accuracy and Delivery Issues

Please make sure your delivery address is complete and accurate at checkout. Orders returned to us due to an incorrect address provided by the customer can be reshipped at the customer’s expense. If tracking shows your package as delivered but you cannot locate it, check with household members and neighbors first, then contact us at spaghetti.miniatures@gmail.com within 7 days, and we will help investigate with the carrier.

3.5 Damaged in Transit

If your order arrives damaged, contact us within 48 hours of delivery with photos of the packaging and the item. We will arrange a replacement or refund — see our Returns & Refunds Policy.

4. RETURNS & REFUNDS POLICY

Effective date: August 11, 2026

Returns for purchases on SpaghettiMiniatures.com are handled by TIUS Corp, the seller of record. This policy matches the return terms our team offers across our stores.

4.1 Return Window

You may return most new, unopened items within 30 days of delivery for a full refund of the item price.

4.2 Return Shipping Costs

If the return is a result of our error — for example, you received an incorrect or defective item — we will also pay the return shipping costs. For other returns (such as a change of mind), the customer is responsible for return shipping, and the item must arrive back to us in new, unopened, resalable condition.

4.3 How to Start a Return

  • Email spaghetti.miniatures@gmail.com with your order number and the reason for the return.
  • We will confirm eligibility and send you return instructions and the return address. Please do not ship a return before receiving instructions.
  • Pack the item securely, ideally in its original packaging, and use a tracked shipping method.

4.4 Refund Timing

You should expect to receive your refund within four weeks of giving your package to the return shipper; in many cases you will receive it sooner. This window includes transit time for us to receive your return (5–10 business days), our processing time (3–5 business days), and your bank’s processing time (5–10 business days). Refunds are issued to the original payment method.

4.5 Exceptions

  • Items that have been used, or consumable items with broken seals, cannot be returned unless defective.
  • Defective items are covered by the product’s warranty terms even outside the 30-day window — contact us and we will help with a warranty claim.
  • Nothing in this policy limits any rights you have under applicable law.

5. EDITORIAL INDEPENDENCE & COMMERCIAL DISCLOSURE

5.1 Two Independent Companies

SpaghettiMiniatures.com is owned by Spaghetti Miniatures LLC, the independent publisher behind all reviews, articles, scores, and videos on this Site and on the Spaghetti Miniatures YouTube channel. The store on this Site is operated by TIUS Corp, a separate, independently owned company that is the authorized North American distributor of RichPen® airbrushes. TIUS Corp is the seller of record for every product sold here. Neither company owns any part of the other.

5.2 What This Means for Our Content

  • The store sells products that our content reviews favorably — primarily RichPen. You should read every RichPen review here knowing that products from that brand are sold on this same website.
  • Spaghetti Miniatures LLC benefits commercially from the operation of this Site. That is a material connection, and we disclose it here so you can weigh our reviews accordingly.
  • Reviews of other brands (such as Harder & Steenbeck, Iwata, Gaahleri, and Madworks) reflect independent testing. Those brands do not sponsor our content, and we do not accept payment for favorable coverage from any manufacturer.
  • The Spaghetti Score methodology, testing procedures, and editorial conclusions are controlled solely by Spaghetti Miniatures LLC. TIUS Corp does not review, edit, or approve editorial content before publication.

5.3 Product Purchases

When you buy through this Site, your purchase is from TIUS Corp under its Terms of Service, Shipping Policy, and Returns & Refunds Policy. Editorial opinions are not a warranty of product performance; product warranties come from the product documentation and applicable law.

5.4 If This Relationship Changes

If the relationship between Spaghetti Miniatures LLC and TIUS Corp materially changes — for example, through employment, sponsorship, or ownership — this disclosure will be updated to reflect it. The Effective date above shows the current version.
